To use the AirBeam Wi-Fi/Internet Broadband service, please note the terms and conditions under which the service is provided.
Agreement
This agreement is entered between the subscriber (particulars of whom mentioned in the overleaf to this agreement) and Japra Tele Link Pvt.Ltd. alias ‘AirBeam’ (a company registered under the department of Telecommunication) having its registered office at 2nd Floor, Japra Building, above Japra Sales Corporation, Sutehri Road, Hoshiarpur-146001
Terms:
- The term of this agreement shall commence upon AirBeam accepting the form overleaf duly signed by the subscriber, and shall run till either of the parties terminates the agreement or on the request for disconnection/surrender by the subscriber.
- The agreement shall run in concurrence with License granted to Japra Tele Link By Department of Telecom for the purpose of providing Internet and Internet Telephony services in SSA of Hoshiarpur.
- The agreement has been duly authorized, executed, valid binding and enforceable by law in accordance with its terms. AirBeam reserves the right to reject any application without assigning any reason. The customer if wishes to increase AirBeam service can be done at any time during the service duration.
Subscriber Obligation:
- Subscriber should use the Wi-Fi/internet broadband service in accordance with the Terms of Use.
- Subscriber should use a valid account to access Wi-Fi/Internet broadband service.
- Subscriber should keep your AirBeam username and password confidential. The leakage of password or any illegal outcome from your username, the user will be held responsible and all the legal action will be taken against the user.
- Subscriber should check AirBeam customer application form number of its authenticity before making any payment or giving any documents, in case of any duplicity/forgery, Airbeam will not be held responsible.
- Subscriber should not use the Airbeam Wi-Fi/internet service for any activities or transmit via the Airbeam Wi-Fi/internet service, any information or materials, which breach any laws or regulations, infringe a third party’s rights or privacy or are contrary to any relevant standards or codes.
- Subscriber should not resort to hacking or destroying the internet sites including the websites of AirBeam.
AirBeam Obligation:
- Upon receiving an explicit consent from the subscriber, AirBeam reserves its right to activate and charge the subscriber for services activated by it.
- Any delay in payment/part payments of any bill, non-payment of any disputed charges pending settlement non deposit of any increased deposit/advance etc may result in de-activation at the sole discretion of airbeam without any liability. Reactivation shall be at the sole discretion of Airbeam.
- AirBeam is entitled to change, vary, add and withdraw any service, supplementary service and/or to vary its charges relating thereto at any time, in its sole discretion and/or under TRAI regulation and guidelines.
Billing and Payment:
- Bills are inclusive of monthly rentals, installation charges, security charges, reconnection charges, service tax and charges for other services. The respective charges may be added deleted and/or varied by AirBeam in its sole discretion from time to time with prior intimation to the subscriber.
- The billing cycle shall run of monthly/quarterly/half yearly/yearly basis whichever applicable or such other frequency as may be decided by the AirBeam from time to time AirBeam reserves the right to change the billing cycle as and when deemed necessary.
- Cheques /DD’s can be made in favor of ”Japra Tele Link Private Limited.”
- Outstation cheques will not be accepted however at the sole discretion of AirBeam, outstation cheques, if accepted may bear a charge as decided by AirBeam.
- All customers own the liability for the cheques submitted against the subscription. Any such cheque getting dishonored will invite penalty of Rs.500/- on customer.
- For Broadband internet connection installation, 20 meter wire can be used, beyond 20 meters Rs.15 per meter will be charged.
- Late fees penalty upto Rs. 500 and interest @ 12% shall be applicable.
Service Discontinuation:
- The customer may opt to discontinue the Wi-Fi/Internet Broadband services by providing a written notice to the Japra Tele Link Pvt. Ltd. of at least one month before the completion of service duration for which customer has already paid all the required charges.
- Neither party shall be liable to the other party or any other third party for any damages, both direct or indirect and consequent to such discontinuance of service by the customer.
- AirBeam Internet modem is AirBeam’s property. Discontinuance will not be accepted till the Airbeam internet modem is returned back to Airbeam. If not returned, continuation of the service will be presumed and previous month billing plan will be applicable in the following month.
- If the subscriber cancels his service order after work has been started on the provision of the service, the subscriber shall reimburse AirBeam for the cost of such work. AirBeam may alternatively deduct these costs from any advance payment deposit which the subscriber may have paid towards the provision of the service or from any other entitlement due to the subscriber from the company. In the event of termination of the agreement for any reason whatsoever. AirBeam shall be entitled to recover all outstanding charges and dues from the subscriber along with the CPE.
- If the agreement is terminated for reason of wrong, incorrect or fraudulent information provided by subscriber, AirBeam can at its discretion, terminate the agreement and recover all dues without any liability on AirBeam.
Payment:
Customer shall be responsible for payment in full and before the due date of invoices, if any of the service. Customer shall be responsible for all applicable installation fee, activation cost, and taxes. Installation cost, activation cost is non-refundable. If any security (refundable) is taken at the time of taking the service, the same can refunded only when original receipt is shown/returned at the time of refund.
Limitation of Liability:
- Given the nature of telecommunication systems, particularly the internet, we cannot guarantee that AirBeam Wi-Fi/Internet will always be available or will be error free.
- If at any time, during the continuance of services, the performance in whole or part, of any obligation under it shall be prevented or delayed by reason of war, hostility, acts of the public enemy, civil commotion, sabotage, fire, flood, explosion, epidemic, quarantine restriction strikers, lock out or act of natural calamities etc, the customer shall not have any claim for damages against AirBeam in respect of such non-performance or delay in performance of service(s).
- Services may be suspended in whole or in part at any time without notice if the network requires urgent modification or maintainance. AirBeam shall make all responsible efforts to minimize the frequency and duration of such events.
- AirBeam customer should use AirBeam Internet modem for AirBeam Wi-Fi/Internet services. In case of other ISP’s modem used the AirBeam user cannot claim good quality of AirBeam services.
- AirBeam will not be responsible for any acts of franchisees of any third party with regards to scheme which are not authorized by AirBeam or which are purported to have been offered on behalf of AirBeam without the letters explicit and specific sanction in written.
Rates and Service Changes:
AirBeam reserves the right to alter, vary, change, any or all its service plans without prior notification.
Service Outage:
You acknowledge and understood that the service will not function if there is a power outage or you have a Wi-Fi/Internet broadband connection service outage. AirBeam will endeavor to maintain continued service but will not be held responsible for outages resulting from Wi-Fi/Internet Broadband connection services.
Quality of service:
The quality of service is as per TRAI rules, Internet services are on shared basis as per TRAI rules.
Change of contact:
Any change of customer address or contact number shall be notified by the customer to AirBeam in advance in addition, if the CPE/ any other hardware is to be shifted to other premises necessary shifting charges will be paid by the customer.
Assignment/Transfer:
Customer shall not transfer his liabilities and obligation to any other party. AirBeam may assign this contract at any time. Assignment by AirBeam does not negates the contract’s binding effect on the customer.
Prohibititory Clauses:
Wi-Fi/ Internet Broadband services provided by AirBeam shall be only used by the customer or the person authorized by him for their own personal use and shall be resold by the customer or person authorized by him any way.
Jurisdiction:
In the event of any disputes, differences or controversies, arising between the parties here to, out of or in relation to or in connection with the terms and conditions or any action taken hereunder, the parties shall explore all possibilities for an amicable settlement. In case amicable settlement is not reached, such dispute, differences, controversies shall be settled by Arbitration. The arbitrator will be appointed by ‘Japra Tele Link’ alias ‘AirBeam’ whose decision shall be binding on both the parties. The venue of such arbitration and all other legal jurisdiction shall be at Hoshiarpur.
Use of Customer information:
When you send us any feedback, suggestions, ideas or other materials in relation, you agree that we can use, reproduce, publish, modify, adapt without restriction.
Data Security and Usage Policy
To Communicate with You: We may use your information to respond to your inquiries, provide customer service support, send you important information about the services, and marketing communications (with your consent) via different channels, including but not limited to SMS, Email, RCS, WhatsApp, and Voice.
